1. Introduction
Welcome to RiverWindStudio ("we," "our," or "us"). These Terms & Conditions ("Terms") are applicable to your usage of our yacht charter services and our website at riverwindstudio.site, which is managed by RiverWindStudio.
By reserving a yacht or using our Service, you consent to comply with these Terms. If you object to any section of these terms, you do not have access to the Service.
2. Service Overview
RiverWindStudio offers luxury yacht charter services, which include, but are not limited to:
- Yacht rentals for a day
- Evening boat trips
- Business retreats
- Exclusive gatherings
- Extended charters
Access to services is conditional on availability and the weather. We retain the prerogative to modify or cancel services without prior notice.
3. Booking and Reservations
3.1 Booking Process
Criteria for booking a charter include:
- Minimum age requirement of 18 years
- Submission of precise and full personal details
- Provision of a deposit as outlined in the booking acknowledgement
- Adherence to these Terms & Conditions
3.2 Confirmation
Booking confirmation is contingent on payment receipt and issuance of our written acknowledgment. Reservation services may be declined at our discretion.
3.3 Availability
Charters are contingent on yacht availability and favorable weather conditions. We strive to adhere to your desired schedule and dates.
4. Payment Terms
4.1 Pricing
Our pricing is in € and includes all applicable taxes, unless stated otherwise. Pricing is subject to alteration without prior notification.
4.2 Payment Schedule
- Initial payment: 50% of the total cost of the charter, payable upon booking
- Remaining balance: Due 48 hours prior to the departure of the charter
- Incidental expenses (if applicable): Payable upon completion of the charter
4.3 Payment Methods
We accept major credit cards, electronic bank transfers, and certified checks. All payments are processed through secured, encrypted channels.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelled more than 72 hours before departure: Full reimbursement minus administrative fees
- If cancelled between 24 to 72 hours before departure: Half of the payment will be refunded
- If cancelled less than 24 hours before departure: No refund will be provided
5.2 Weather Cancellations
In the instance of weather conditions being deemed unsafe by our captain, we will propose either:
- Rebooking for the next available slot, not incurring any additional charges
- A complete refund if rescheduling is unfeasible
5.3 Mechanical Issues
In case there is a mechanical failure with the assigned vessel, we will endeavor to offer an acceptable alternative. When no other option is available, a full refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are to:
- Abide by all the crew's directives
- Utilize safety gear when mandated
- Announce any medical conditions that may impact their safety
- Stay within the designated passenger areas on the vessel
6.2 Prohibited Items
The entry of the subsequent items is not allowed on board:
- Containers made of glass
- Unlawful substances
- Weapons or any kind of firearms
- Grossly excessive amounts of non-alcoholic drinks
- Animals (unless prior authorization has been obtained)
6.3 Conduct
Behavior of passengers should be dignified and respectful. Any conduct that endangers safety or impairs the enjoyment of others may result in cessation of the charter with no refund.
7. Liability and Insurance
7.1 Our Liability
Our responsibility is limited strictly to the amount paid for your charter. We decline liability for:
- Physical harm stemming from the negligence of passengers
- Destruction or loss of personal belongings
- Indirect or secondary damages, including punitive damages
- Postponements induced by weather or unforeseen situations out of our control
7.2 Insurance Coverage
We provide comprehensive maritime insurance that encompasses both our fleet and operations. Personal travel and belongings insurance is the responsibility of our passengers.
7.3 Assumption of Risk
By opting for our charter services, you recognize that nautical activities carry innate risks, accepting personal responsibility for your safety and well-being.
8. Modifications and Itinerary Changes
We hold the right to revise itineraries, routes, or schedules as per weather patterns, safety considerations, or operational demands. We will make all reasonable efforts to offer alternative experiences of comparable value.
9. Force Majeure
Delays, cancellations, or changes caused by factors outside of our control, including but not restricted to:
- Extreme weather situations
- Natural calamities
- Regulatory actions by the government
- Closures of ports
- Technical failures
10. Privacy and Data Protection
We respect your privacy and handle your personal details in accordance with our Privacy Policy. Utilizing our services constitutes your consent to our collection and utilization of your information per the Privacy Policy.
11. Intellectual Property
Every element of our website, such as text, graphical depictions, emblems, and images, falls under copyright and trademark legislation. You must not replicate, distribute, or generate derivatives without obtaining authorization in writing from us.
12. Governing Law
The laws of Germany govern these Terms, with legal issues being addressed in the courts within Hamburg, Germany.
13. Changes to Terms
We may revise these Terms at any time. Amendments will be notified on our website with a revised date. Continued service use signifies acceptance of the new terms.
